INDOOR CYCLING AND PROGRAMS

WAIVER AND RELEASE OF LIABILITY AGREEMENT

By checking the box associated with this Waiver and Release of Liability Agreement, the Participant releases and forever discharges 1372514 B.C. Ltd., The Cycle Collective Ltd., its owner, directors, officers, employees, agents, assigns, legal representatives and successors (collectively, referred to as the Activity Provider) from all manner of actions, causes of action, debts, accounts, bonds, contracts, claims and demands for or by reason of any injury to person or property, including injury resulting in the death of the Participant, which has been or may be sustained as a consequence of the Participant's participation in the Activity described below, and notwithstanding that such damage, loss or injury may have been caused solely or partly by the negligence of the Activity Provider.

The Participant acknowledges that there are inherent risks to health and injury associated with the Activity which is strenuous and physically challenging and which may cause or exacerbate injury or impairment to health. The Participant accepts this risk and accepts personal responsibility to gauge the level of intensity of the Activity to protect their health.
This Waiver and Release of Liability Agreement is made in consideration of the Activity Provider providing the Participant with the Activity, and the Participant understands that the Participant would not be permitted to participate in the Activity described below unless the Participant agreed to this waiver and Release of Liability Agreement.


The Activity
The Activity includes any physical activity programs provided by The Activity Provider including but not limited to indoor cycling, outdoor cycling, group fitness and personal training.


Waiver and Release
The Participant acknowledges that this Waiver and Release of Liability Agreement is made with the express intention of effecting the extinguishment and waiver of certain legal obligations owed to the Participant and with the intention of binding the Participant's spouse, heirs, executors, administrators, legal representatives and assigns.


Fitness to Participate
The Participant acknowledges that the Participant does not have any physical limitations, medical ailments, or physical or mental disabilities that would limit or prevent the Participant from participating in Activity. The Participant acknowledges personal responsibility for their own health and, the Participant will take responsibility for obtaining a medical examination and clearance to participate in the Activity.


Full and Final Settlement
The Participant hereby acknowledges and agrees that the Participant has carefully read this Agreement, that the Participant fully understands the same, and that the Participant is freely and voluntarily executing the same.
The Participant understands that by agreeing to the Waiver and Release of Liability Agreement, the Participant agrees to be forever prevented from suing or otherwise claiming against the Activity Provider for any property loss or personal injury that the Participant may sustain while participating in or preparing for the above-noted Activity.
This Agreement contains the entire Agreement between the parties to this Agreement and the terms of this Agreement are contractual and not a mere recital.


Governing Law
This Agreement will be governed by and construed in accordance with the laws of the Province of British Columbia.

STUDIO POLICIES

CANCELLATION POLICY:

By creating an account and booking any class with The Cycle Collective you agree to the cancellation policy. All classes must be canceled no later than 12 hours prior to the scheduled start time. Any class canceled by the user within 12 hours of the start time will result in that class credit being deducted from the user’s account.

NO-SHOW POLICY:

Any user that does not show up to a reserved class is subject to the studio’s no-show policy. This takes effect 5 minutes after the scheduled start time of any class. Users utilizing class packs or drop-ins will forfeit that credit. Users with All Memberships will receive a no-show penalty in the form of a $7.50 monetary amount placed against their account.

EXPIRATION PERIOD:

Any user making a purchase agrees to the outlined expiration period associated with each package and/or membership. The user acknowledges that extensions are not guaranteed and are at the discretion of The Cycle Collective staff. Monthly Memberships may be temporarily paused up to the maximum allowed duration for each. Month-to-Month memberships are not eligible for temporary pauses.

PERSONAL BELONGINGS:

Any user attending in-studio classes agrees that The Cycle Collective is in no way responsible for the safekeeping of their personal belongings. The user assumes all risks of loss of personal belongings. This includes the storage of bicycles inside the studio facility.

NON-HARASSMENT POLICY:

At The Cycle Collective, we strive to create a safe and inclusive environment for all clients. We are committed to maintaining a zero-tolerance policy against harassment of any kind. This policy applies to all clients and attendees of our fitness studio, including members, guests, employees, and contractors. Harassment includes any unwelcome behavior, comments, gestures, or actions that create an intimidating, hostile, or offensive environment for others. This policy applies to interactions within our studio premises, as well as any virtual or online platforms associated with our services.

We encourage anyone who experiences or witnesses harassment within our fitness studio to report the incident promptly. Reports can be made to any staff member, instructor, or management personnel. We take all reports seriously and will promptly investigate and address each complaint in a fair and confidential manner.

WEATHER POLICY (OUTDOOR RIDES):

All outdoor cycling classes are subject to our weather policy in order to keep staff and participants safe. Should the forecast call for significant rainfall, snowfall, sleet, hail, or other precipitation, then the company reserves the right to cancel the scheduled class before its scheduled start time. Postponements or cancellations may also take place in the event of extreme temperatures or wind warnings. The company will email the cancellation to all participants informing them of the decision to postpone or cancel the class.
